Abstract: In order to explore the factors influencing the evaluation of competence for serve a sentence, 102 cases of forensic psychiatric expertise were reviewed. A questionnaire of scale of adaptability to punishment circumstance" was designed to investigate these cases. The results showed that the patients of psychotic mental disorders and the patients with history of mental disorders have a relatively high rate of non-competence of serving sentences, and that they can not adapt theirself to punishment circumstance .
